The U.S. has introduced a 10% tariff on all imports starting April 5, 2025, with higher rates for specific countries like the EU (20%) and China (up to 125%). A 90-day pause applies to most countries except China. Additional tariffs target cars and aluminum cans, aiming to address trade imbalances.

From January 25, 2025, the EU is extending anti-dumping and countervailing duties on Chinese e-bikes, with rates ranging from 3.9% to 70.1%. Imports without a valid commercial invoice will face the highest duties.

From 1 February 2025, the EU-Chile Interim Trade Agreement (ITA) introduces tariff reductions and new proofs of origin, replacing the EUR.1 certificate. No transition period applies, meaning goods in transit must comply immediately. Exporters must indicate origin as "EU" or "Chile," and records must be kept for up to four years.

Penalties for non-compliance can be significant, with fines based on penalty units, and failure to pay may lead to prosecution or court-ordered civil penalties.

The EU has imposed five-year countervailing duties on Chinese battery electric vehicles (BEVs) to address unfair subsidies that threaten EU producers, with rates ranging from 7.8% to 35.3%, depending on the exporter. The Commission remains open to negotiating price undertakings and allows importers to seek refunds if subsidies can be disproven.

New EU Regulation Targets Deforestation in Trade. Beginning at the end of 2024, Regulation (EU) 2023/1115 will enforce strict rules on imports linked to deforestation, including wood, rubber, and palm oil. Products must be deforestation-free and comply with local laws and due diligence. Non-compliance may lead to fines and market exclusions, reinforcing the EU’s commitment to biodiversity and forest protection by 2030. Stay informed and prepare your supply chain.

The A.TR certificate allows duty reductions for EU-Turkey trade. Initially requiring manual signatures, electronic versions were accepted during COVID-19. In 2024, Turkey resumed wet ink signatures, but the EU now recognizes QR codes as valid. A formal decision retroactive to 8 July 2024 is pending, with the EU advising early acceptance.

Switzerland's new digital customs system, Passar, launched in 2024, will fully replace e-dec Export by 2025 and e-dec Import by 2026, aiming to streamline trade and eliminate paper documents. It enhances transparency and flexibility in export declarations, with integration efforts ongoing among FOCBS, software providers, and the trade sector.

The EU's new Import Control System 2 (ICS2) enhances customs risk analysis by requiring advance cargo data submission before goods arrive. Economic Operators must provide an Entry Summary Declaration (ENS) with key shipment details to receive customs approval. Failure to comply may result in shipment delays, penalties, or rejections. ICS2 is being rolled out in phases, with maritime and rail carriers required to comply by 2024-2025.

Global supply chains face renewed strain from rising freight rates, port congestion, and geopolitical tensions. The Red Sea Crisis and increased U.S.-China trade demand are key disruptors. Freight rates have surged, schedule reliability has dropped, and equipment shortages persist. Ongoing challenges are expected to keep supply chains under pressure.

Brazil's new Single Import Declaration (DUIMP) streamlines trade by replacing traditional import documents and integrating with the Siscomex portal. Set for full implementation by October 2024, it simplifies tax payments and enhances efficiency.

Companies often choose DDP for convenience, but it can lead to issues like double taxation and lack of control over costs. The Australian Border Force holds the importer accountable for customs errors, even if caused by the supplier, increasing the risk of penalties. For large projects with multiple consignments, miscalculating shipment values can result in compliance risks and potential fines.

Transfer pricing can impact customs valuation when related parties are involved. Customs may reject the Transaction Value (TV) if the price is influenced by the relationship. Importers must provide evidence showing the price isn't affected by the relationship. If rejected, adjustments can be made using "Test Values." Businesses should ensure transactions are at arm’s length and consider seeking a Valuation Ruling.
